This Legal Notice hereinafter referred to as the “Legal Notice” governs access to, browsing and use of the website highqcell.com hereinafter referred to as the “Website”, relating to the Zuccato Biotech division, the regenerative medicine division of ZUCCATO HC S.r.l. hereinafter referred to as “ZUCCATO HC” or the “Company”, the sole legal entity owning the Website.
It is specified that Zuccato Biotech is not an independent legal entity, but represents an internal organizational division of ZUCCATO HC S.r.l., used for commercial and sector-specific identification of the activities dedicated to regenerative medicine. Any reference on the Website to “Zuccato Biotech” shall therefore be understood as referring to ZUCCATO HC S.r.l. as the sole entity holding rights, obligations and responsibilities.
Access to and browsing of the Website imply full acceptance of this Legal Notice. Users who do not intend to accept it are invited to refrain from using the Website.

2. Purpose and nature of the Website
The Website is informational and institutional in nature and is primarily intended for healthcare professionals, medical sector professionals and professionally qualified individuals interested in the products, technologies and regenerative medicine projects promoted by the Zuccato Biotech division.
The Website does not in any way constitute an e-commerce platform or a promotional tool aimed at the general public of patients or consumers. The published content, including descriptions of medical devices by way of example: PBMNC High Q Cell®, ADSC Lipo-Stem®, RGTA Cacipliq20®, GLASS AktiBone® and their related fields of application, is provided exclusively for informational and educational purposes and does not in any way replace the advice, diagnosis or prescription of a qualified healthcare professional.
No information on the Website may be interpreted as medical advice, therapeutic indication, clinical recommendation or promise of results. The use of the devices presented is reserved exclusively for qualified healthcare personnel, in accordance with the indications for use, contraindications, warnings and limits set out in the instructions for use IFU and in the authorized technical documentation of the respective manufacturers.
3. Warnings regarding medical devices
The products illustrated on the Website are medical devices or in vitro diagnostic medical devices subject, as applicable, to Regulation EU 2017/745 MDR, Regulation EU 2017/746 IVDR, Legislative Decree no. 46 of 24 February 1997, Legislative Decree no. 332 of 8 September 2000 and Legislative Decree no. 137 of 5 August 2022.
ZUCCATO HC operates as a distributor and/or economic operator pursuant to the MDR. The devices presented on the Website are CE marked in accordance with the applicable European regulations and are accompanied by the documentation prescribed by their respective manufacturers, who remain fully responsible as manufacturers pursuant to Articles 10 et seq. of the MDR.
Any incidents or serious incidents pursuant to Article 2, points 64 and 65, of Regulation EU 2017/745 occurring during the use of devices distributed by ZUCCATO HC must be promptly reported to the Company at vigilanza@zuccatohc.it, without prejudice to the obligation of the healthcare professional or healthcare facility to report them to the Italian Ministry of Health in accordance with the procedures provided for by the applicable legislation on medical device vigilance.
Any healthcare advertising conveyed through the Website is carried out in compliance with Articles 7 and 8 of Legislative Decree no. 46 of 24 February 1997, Legislative Decree no. 541 of 30 December 1992 where applicable, Article 6 of Regulation EU 2017/745 and the guidelines of the Italian Ministry of Health.
4. Intellectual property and copyright
All Website content — including, by way of example but not limited to: texts, photographic images, illustrations, videos, graphics, layouts, source code, databases, registered and unregistered trademarks, logos, trade names, distinctive signs, domain names, sounds and related adaptations — is protected by Italian and European legislation on intellectual and industrial property, including Law no. 633 of 22 April 1941 Copyright Law, Legislative Decree no. 30 of 10 February 2005 Industrial Property Code, Regulation EU 2017/1001 on the European Union trade mark and applicable international conventions.
All rights relating to the Website content are exclusively owned by ZUCCATO HC S.r.l. or by the respective legitimate owners such as, for example, the manufacturers of the distributed devices: OTR3, Noraker, Quantix, Biopsybell and other industrial partners, from whom ZUCCATO HC has obtained the necessary licenses for publication.
Trademarks and distinctive signs such as, by way of example, Zuccato Biotech®, High Q Cell®, Lipo-Stem®, Cacipliq20®, AktiBone® and any other trademark mentioned on the Website are used exclusively for descriptive and identification purposes relating to the products and their manufacturers, and do not imply any transfer or waiver of rights.
Any reproduction, even partial, dissemination, publication, distribution, modification, translation, adaptation, decompilation, reverse engineering, extraction and reuse of substantial portions of databases, or any other use of the Website content without the prior written consent of ZUCCATO HC, is prohibited, without prejudice to the free uses expressly provided for by law in particular Articles 65 et seq. of Law no. 633/1941.

Any dispute arising in relation to its interpretation, execution or validity shall fall under the exclusive jurisdiction of the Court of Verona, without prejudice to any mandatory consumer court that may apply pursuant to Articles 33 et seq. of Legislative Decree no. 206 of 6 September 2005 Consumer Code.
